AddPath End User License Agreement (EULA)

1. Acceptance of Terms​

By installing, accessing, or using AddPath ("the Software"), you agree to be bound by the terms of this End User License Agreement ("EULA"). If you do not agree to these terms, do not install, access, or use the Software. You may return it to the place of purchase for a full refund.

2. Definitions​

  • "Addcomposites," "We," "Us," or "Our" refers to Addcomposites Oy.
  • "You" or "Your" refers to the individual or entity that owns the license to use the Software.
  • "Software" refers to AddPath and its associated online documentation and content.

3. Software License Grant​

Addcomposites grants you a non-exclusive, non-transferable license to use the Software subject to the following conditions:

  • a) The License is installed on a computer or virtual machine you own, lease, rent, or license.
  • b) The number of login sessions running the Software simultaneously does not exceed the number of licenses you own.
  • c) Unless otherwise noted, each license is a single (1) user license.
  • d) You may use the Software for internal business purposes and research only.

An Upgrade License extends your existing License to include running a newer version of AddPath. It does not change the number of Users who can use AddPath simultaneously.

4. Intellectual Property Rights​

AddPath is owned by Addcomposites Oy and is protected by copyright laws, international copyright treaties, and other intellectual property laws and treaties. The Software is licensed, not sold.

You agree not to (nor authorize third parties to) reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying ideas, algorithm, or structure of the Software provided to you in object code form, except to the extent specifically permitted by applicable law.

5. Use Restrictions​

You may not:

  • a) Distribute, sublicense, or resell any portion of the Software or materials accompanying the Software.
  • b) Modify or create derivative works based on the Software.
  • c) Use the Software for any illegal purposes or in violation of export control laws.

6. Data Usage and Privacy​

Addcomposites collects and uses data in accordance with its Privacy Policy, which is incorporated by reference into this EULA. For full details on data collection, usage, and protection, please refer to our separate Privacy Policy.

7. Warranty Disclaimer and Limitation of Liability​

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL ADDCOMPOSITES OY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADDCOMPOSITES OY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Support and Updates​

Technical support for the Software is provided as outlined in our separate Support Policy. Addcomposites may, at its discretion, provide updates or upgrades to the Software. The terms of this EULA will govern any such updates unless separate terms are provided.

9. Termination​

This EULA is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Software and destroy all copies, full or partial, of the Software.

10. Governing Law and Jurisdiction​

If you are located in the European Union and are using the Software in the European Union, this EULA will be governed by and construed in accordance with the laws of Finland (excluding its conflict of laws principles and the U.N. Convention on Contracts for the International Sale of Goods).

If you are located in the United States and are using the Software in the United States, this EULA will be governed by and construed in accordance with the laws of the state of Finland.

For all other locations, this EULA will be governed by and construed in accordance with the laws of the state of Finland.

You expressly agree that exclusive jurisdiction for any claim or dispute with Addcomposites or relating to your use of the Software resides in the courts of Finland.

11. Export Control Compliance​

You agree to comply with all applicable export control laws and regulations in your use of the Software. You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which export of the Software would be prohibited by applicable laws.

12. Confidentiality​

You agree to maintain the confidentiality of any proprietary information received from Addcomposites in connection with the Software and to use such information only for the purposes for which it was provided.

13. Amendments​

Addcomposites reserves the right to amend this EULA at any time. We will notify you of any changes by posting the new EULA on our website and updating the "Effective Date" at the top of this EULA. Your continued use of the Software after any such changes constitutes your acceptance of the new EULA.

14. Specific AddPath Features​

  • a) Digital Twin Capabilities: Use of the digital twin features within AddPath is subject to the terms of this EULA and any additional terms provided with those features.
  • b) FEA Integration: The Software's integration with Finite Element Analysis (FEA) tools is provided subject to any limitations specified in the documentation.
  • c) Defect Detection and Analysis: Use of defect detection and analysis features is permitted solely for internal quality control purposes and should not be relied upon as a sole means of ensuring product safety or compliance with industry standards.

15. Entire Agreement​

This EULA constitutes the entire agreement between you and Addcomposites concerning the Software and supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the Software or any other subject matter covered by this EULA.
